1. About These Terms

These Terms of Service ("Terms") govern your use of the website located at https://rajnandanweb.com ("the Website") and the freelance development services offered by Rajnandan Kushwaha ("I", "me", "my"), operating as an independent freelance developer based in East Champaran, Bihar, India.

By visiting this Website, submitting a contact enquiry, or entering into a service agreement with me, you ("Client", "you", "your") accept these Terms in full.

2. Services Offered

I offer the following freelance development and consulting services:

• Custom web application development (Laravel, PHP, Python, Node.js)
• Front-end development (React, HTML, CSS, Bootstrap, Tailwind)
• Mobile application development (Flutter, React Native)
• REST API design and development
• Database design and optimisation (MySQL, PostgreSQL, SQLite)
• UI/UX design and consulting
• Website maintenance and support
• Technical consultation and code review

The exact scope of work for any project will be defined in a separate project agreement or Statement of Work ("SOW") agreed upon before work commences.

3. Project Engagement Process

A typical project engagement follows these steps:

• Enquiry: You contact me through the website or by email with your project requirements.
• Proposal: I review the requirements and send a written proposal with scope, timeline, and pricing.
• Agreement: Both parties agree in writing (email or signed document) to the project scope and terms.
• Advance Payment: Work begins after receipt of the agreed advance payment (typically 30–50%).
• Development & Review: I develop the project and provide regular updates and review stages.
• Delivery & Final Payment: The final deliverable is handed over upon receipt of any remaining payment.

4. Payment Terms

• All prices are quoted in Indian Rupees (INR) or US Dollars (USD) as agreed.
• Invoices are payable within 7 days of the invoice date unless otherwise agreed.
• Late payments may incur a 2% monthly interest charge on the outstanding balance.
• Accepted payment methods: Bank Transfer (NEFT/IMPS/UPI), PayPal, Wise (TransferWise), or other mutually agreed methods.
• Prices are exclusive of applicable taxes (GST) unless stated otherwise.

5. Revisions and Change Requests

• Each project proposal includes a defined number of revision rounds.
• Revisions within scope are included at no additional charge.
• Changes that expand the agreed scope ("scope creep") will be quoted separately and require written approval before implementation.
• I reserve the right to re-quote the project if requirements change substantially from the original brief.

6. Intellectual Property & Ownership

• Upon receipt of full payment, ownership of the custom code and deliverables developed specifically for your project transfers to you.
• I retain the right to display the project in my portfolio and use it as a reference unless explicitly agreed otherwise in writing.
• Any third-party frameworks, libraries, plugins, or tools used remain subject to their own licences (e.g., MIT, GPL). You are responsible for complying with those licences.
• Pre-existing tools, components, or code templates I have developed independently remain my intellectual property, even if used in your project. A non-exclusive licence to use them is granted upon full payment.

7. Confidentiality

I treat all project information, business logic, credentials, and data shared by clients as strictly confidential. I will not disclose your proprietary information to any third party without your written consent, except as required by law. Similarly, I ask that you treat any proprietary methods, pricing, or code I share with you as confidential.

8. Warranties & Representations

I warrant that:

• The work delivered will be my own original work or properly licensed third-party components.
• I have the right to enter into agreements and deliver the services described.
• Deliverables will function as specified in the agreed project scope at the time of delivery.

A 30-day bug-fix warranty is provided after final delivery, covering defects in functionality as originally specified. This warranty does not cover new feature requests, issues caused by changes made by you or a third party, or hosting/server-related issues.

9. Limitation of Liability

To the maximum extent permitted by applicable law, my total liability to you for any claim arising out of or in connection with these Terms or the services shall not exceed the total amount paid by you for the specific project giving rise to the claim in the 12 months preceding the claim.

I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, however caused.

10. Project Cancellation

• Cancelled by Client: Work completed up to the point of cancellation will be invoiced. Advance payments are non-refundable once work has commenced.
• Cancelled by Me: If I am unable to complete a project due to unforeseen circumstances, I will refund any advance payment proportional to the work not delivered and provide all completed work to date.
• Cancellation must be communicated in writing via email.

11. Use of This Website

You agree to use this website only for lawful purposes. You must not:

• Submit false, misleading, or harmful content through the contact form.
• Attempt to gain unauthorised access to any part of the website or its underlying systems.
• Use automated tools (bots, scrapers) to extract content from this website without prior written consent.
• Engage in any activity that could damage, disable, or impair the website's performance.
• Use the website to transmit spam, malware, or any harmful code.

12. Privacy

Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it to understand our data practices.

15. Force Majeure

Neither party shall be liable for delays or failure to perform obligations due to causes beyond their reasonable control, including but not limited to natural disasters, internet outages, government actions, or health emergencies.

I reserve the right to update these Terms at any time. The "Last updated" date will reflect any changes. Continued use of the website or engagement of services after changes are posted constitutes acceptance of the revised Terms.
